Welcome to our website and thank you for your interest. Protecting your personal data (hereafter: ‘data’) and your privacy during your visit to our website is very important to us. For this reason, we would like to provide you with information about how we handle your data. We reserve the right to adapt the content of this data protection notice from time to time. We therefore recommend that you take note of our data protection notice at regular intervals.

The party responsible for data processing within the context of data protection law is: brand on fire Werbeagentur Hamburg GmbH (hereafter: ‘we’, ‘us’)

2. Personal data

Personal data are any information that relates to an identified or identifiable natural person (‘affected person’). An affected person is considered to be identifiable if they can be identified either directly or indirectly, especially with the assignment of an identifier. For example, a name, an identification number, location data, an online identifier or other particular characteristics, or the expression of the affected person’s physical, physiological, genetic, psychological, economic, cultural or social identity are considered identifiers.

3. Purposes and legal basis for the processing of personal data

a. When visiting our website

You can visit our website without providing personal information. If you use our website purely for informational purposes, we do not collect personal data. The exception to this is data that your browser transmits in order to facilitate your website visit. To enable the technical provision of the website, it is necessary for us to process specific, automatically transmitted information from you so that your browser will display our website and you are able to use it. This information is automatically recorded every time you call up our website and is stored in server log files. In this case, we collect the following information: browser type/version, operating system used, referrer URL (the site visited beforehand), host name of accessing computer (IP address), time of server request. These data cannot be assigned to a specific person and are deleted after nine weeks at the latest. Your IP address will however be anonymised after seven days following call-up of our website. These data are not merged with other data sources. We process your personal data for the technical provision of our website to safeguard our legitimate interests as per Art. 6(1)(f) GDPR. Our legitimate interest consists of being able to provide you with an appealing, technically functional website.

b. When sending an enquiry via email, telephone or post

In order to be able to handle and respond to your enquiry, e.g. via our email address, by telephone or by post, we process the personal data you share with us in this context. For enquiries to our email address, we always process your email address in order to provide you with a response, as well as other information you send to us as part of your message. For enquiries by phone or post, we process the personal data you share with us. The legal basis for processing your personal data in connection with your enquiries is Art. 6(1)(f) GDPR. Our legitimate interest comprises our economic interest in being able to make contact with potential new clients and respond to enquiries appropriately. Personal data transferred to us through enquiries via the contact form, email, telephone or post are stored until your enquiry has been responded to and are then deleted unless we are required to store them for longer due to applicable retention periods.

4. The right to revoke and to object

You have the right as per Art. 21 GDPR to lodge an objection to the processing of your personal data that has taken place due to a legitimate interest on our part or that of a third party, providing reasons arising from your particular situation exist or the objection is aimed at preventing direct advertising in general or that is tailored to you. In the latter case, you have a general right to object that will be executed by us without specification of a special situation.

If you wish to exercise your right to object, please get in touch with us via the contacts listed under item 1.

5. Transmission of data to third parties / data recipients

We do not transmit your data to third parties. We employ the service provider 1&1 Internet SE (‘1&1’) to host our website. In accordance with European data protection standards, we have made special contractual arrangements with 1&1 to process your data strictly on instruction and not for its own purposes, and to adhere to the required security standards.

6. Use of Google AdWords Conversion Tracking

Our use of Google AdWords and associated Conversion Tracking is based on Art. 6(1)(f) GDPR. Google Conversion Tracking is an analysis service from Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; ‘Google’). If you click on an ad delivered by Google, a cookie is deposited on your computer for conversion tracking. These cookies become invalid after 30 days, contain no personal data and cannot therefore be used for personal identification.

If you visit specific pages on our website and the cookie has not yet expired, we and Google can recognise that you have clicked on an ad and were directed to this site. Each Google AdWords client receives a different cookie. There is therefore no possibility that cookies can be tracked via the websites of AdWords clients.

The information collected using the conversion cookie serves to compile conversion statistics for AdWords clients who have chosen to use Conversion Tracking. This allows customers to find out the total number of users who have clicked on their ad and have been directed to a site equipped with a Conversion Tracking tag. We also have a legitimate interest in data processing in this respect. However, we do not receive any information that would allow a user to be personally identified. If you do not wish to take part in tracking, you may object to this use by preventing installation of the cookies via the corresponding setting in your browser software (disable option). You will then not be included in Conversion Tracking statistics. You can find more detailed information, as well as Google’s data privacy policy, at:
https://www.google.com/policies/technologies/ads/, https://www.google.de/policies/privacy/.

7. Automated decision-making / profiling

We do not conduct automated decision-making or profiling (an automated analysis of your personal circumstances).

8. Rights of the affected person

You have the following rights concerning your data processed by us: the right of access to your personal data stored by us as per Art. 15 GDPR; where applicable, the right to rectification of incorrect or the completion of correct personal data stored by us as per Art. 16 GDPR; the right to erasure and to be forgotten for your personal data stored by us as per Art. 17 GDPR; the right to restriction or to block processing of your personal data as per Art. 18 GDPR; where applicable, the right to data portability as per Art. 20 GDPR; the right to object to the processing of your personal data as per Art. 21 GDPR; the right to withdraw consent that has been provided as per Art. 7(3) GDPR; the right to lodge a complaint with a supervisory authority as per Art. 77 GDPR. Please contact us if you have any other queries about the processing of your personal data or to exercise one of the rights available to you.
